  1. Terms

    By accessing the website at http://www.magicfund.rocks (or https://magicfund.rocks) or using this MagicFund mobile application for Apple iOS, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website or mobile application are protected by applicable copyright and trademark law.

  2. Use License

    1. Permission is granted to temporarily download one copy of the materials (information or software) on MagicFund’s website or mobile application for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
      1. modify or copy the materials;
      2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
      3. attempt to decompile or reverse engineer any software contained on MagicFund’s website or mobile application;
      4. remove any copyright or other proprietary notations from the materials; or
      5. transfer the materials to another person or “mirror” the materials on any other server.
    2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by MagicFund at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

  3. Disclaimer

    1. The materials on MagicFund’s website and mobile application are provided on an ‘as is’ basis. MagicFund makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
    2. Further, MagicFund does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or mobile application or otherwise relating to such materials or on any sites linked to this site.

  4. Limitations

    In no event shall MagicFund or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on MagicFund’s website or mobile application, even if MagicFund or a MagicFund authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

  5. Accuracy of materials

    The materials appearing on MagicFund website or mobile application could include technical, typographical, or photographic errors. MagicFund does not warrant that any of the materials on its website or mobile application are accurate, complete or current. MagicFund may make changes to the materials contained on its website or mobile application at any time without notice. However, MagicFund does not make any commitment to update the materials.

  6. Links

    MagicFund has not reviewed all of the sites linked to its website or mobile application and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by MagicFund of the site. Use of any such linked website or mobile application is at the user’s own risk.

  7. Modifications

    MagicFund may revise these terms of service for its website or mobile application at any time without notice. By using this website or mobile application you are agreeing to be bound by the then current version of these terms of service.

  8. Governing Law

    These terms and conditions are governed by and construed in accordance with the laws of Illinois, USA and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

By using the MagicFund app and service you agree to the conditions of the fees detailed here.

Privacy Policy

User Data Collected

In order to use the MagicFund app for Apple iOS, users must create an account with our payment processor, Stripe (http://www.stripe.com).

Upon creating a Stripe account, MagicFund retains the email address and phone number you provide, in addition to metadata provided to MagicFund by Stripe that allows MagicFund to send money to your bank account. MagicFund at no point ever possesses the actual data containing your name or bank account information.

In the ordinary use of the MagicFund app, users generate the following data, which is stored on MagicFund’s servers:

  • data containing which ‘funds’, or donation campaigns, are viewed, reported, ‘shared’, or ‘faved’ by each user;
  • data containing specifics of the user-created ‘funds’, or donation campaigns: i.e. the user-provided fund amount, title, associated image and video, the fund creator’s name; and
  • data containing payout information, specifically when payouts are initiated to users’ bank accounts and whether the payout succeeded or failed.

The MagicFund app includes a Facebook ‘Share’ button that helps users to create posts on Facebook, but MagicFund at no point ever has access to any data of its users’ Facebook accounts.

When using the MagicFund website (http://magicfund.rocks), users generate the following data, which is stored on MagicFund’s servers (unless stated othewise):

  • data containing the user’s IP address, time of website access, and website subsection viewed, which are all logged on MagicFund’s servers;
  • data containing credit card information, which is sent to Stripe to process payments, but is NOT stored on MagicFund’s servers;
  • data containing specifics of any donation made to any fund: i.e. donation amount, an optional donation comment; and
  • metadata about payment information provided to Stripe, which is used to assist in the payment process.

Usage of User Data

MagicFund presents some data of some MagicFund users to other MagicFund users in the normal course of doing business and hosting a great commission-driven, donation-based crowdfunding platform. Specifically, data shared among MagicFund users is limited to the data connected to the crowdfunding campaigns hosted by MagicFund (and associated metadata for each campaign), and data connected to donations and commissions received by MagicFund users.

MagicFund does not intentionally or knowingly transmit any collected user data to any corporate 3rd party for any reason, with the sole exception of Stripe, in which case MagicFund only provides Stripe with user data necessary to collect donations and initiate payouts to users accordingly.
